In an action to recover damages for personal injuries, etc., the plaintiffs appeal from a judgment of the Supreme Court, Suffolk County (Gowan, J.), entered January 4, 1995, which, upon *620granting the defendants’ motions for judgment as a matter of law, is in favor of them and against the plaintiffs dismissing the complaint.
Ordered that the judgment is modified by deleting the provision thereof which dismissed the complaint insofar as it is asserted against the defendant Herco, Inc.; as so modified, the judgment is affirmed, with costs payable to the appellants by Herco, Inc., and the matter is…
