This case presents two questions: (1) whether Appellant’s trial became fundamentally unfair where, after the military judge denied Appellant’s request for a forensic psychologist expert witness, the Government presented such a witness during its rebuttal case; and (2) whether the military judge erred in failing to dismiss charges under Articles 80, 104, and 134, Uniform Code of Military Justice (UCMJ), 10 U.S.C. §§ 880, 904, 934 (2000), because the charges were based on a single transmission of information to those Appellant believed to be the…
