Appeal from an order of Hon. Edward Mclver, Circuit Judge, refusing to set aside the service of the summons and complaint in an action for damages. The plaintiff is a resident of Dillon County and the defendant a domestic corporation, with its principal place of business in Columbia. Process was served on D. Cottingham in the town of Dillon, upon the theory that Cottingham was an agent of the defendant. Defendant denies that Cottingham was its agent, and the validity of the service is challenged on that ground.
