THE COURT.
Plaintiff and defendant both appeal from a judgment of the trial court rendered in an action brought by plaintiff against the defendant for damages for breach of contract to exchange real property. The jury brought in a verdict for plaintiff in the sum of $4,300. Defendant appeals from the entire judgment, contending that the only memorandum of the contract signed by it or its agent is insufficient to satisfy the statute of frauds.
