NEVILLE, District Judge.
In this criminal prosecution for alleged failure to submit to induction into the Armed Forces of the United States as charged in an indictment returned October 16, 1969, defendant originally demanded a jury trial. Court and counsel conferred in chambers prior to the opening of the trial, the substance of which conference later was read into the record in open court in the presence of the defendant.
