VAN DUSEN, Circuit Judge.

This case is before the court on appeal from a March 17, 1967, judgment and commitment following a jury verdict finding appellant guilty of violating Section 12, Title I, of the Universal Military Training & Service Act (50 U.S.C. App. § 462(a)).

The one-count indictment charged that appellant, being required by law under a written order to appear and report for induction on September 28, 1965, did “knowingly, willfully and unlawfully fail to report for such induction * * * at the time and place specified * * * ” in violation of 50 U.S.C.
