WALD, Chief Judge:

On January 10, 1985, as he was heading home from a morning of shopping, Ivar Queen, a resident of Washington, D.C., was run over by a city transit bus. Both of his legs were fractured. Queen brought suit in federal district court against the Washington Metropolitan Area Transit Authority (“WMATA”), contending that WMATA’s bus driver had negligently operated the bus that struck him.
