McDADE, District Judge.

Before the Court is Plaintiff Caterpillar Inc.’s Motion for Summary Judgment [Doc. # 58]. The Court grants this motion for the following reasons.

BACKGROUND

Plaintiff Caterpillar Inc. (“Caterpillar”) is a Delaware corporation with its principal place of business in Peoria, Illinois. Caterpillar manufactures, sells, and distributes earthmoving equipment and engines and engages in other related activities throughout the United States and the rest of the world.
