Despite his claim of innocence, the accused, Miller, was convicted — following a common trial with one Landry— of the unlawful possession of marijuana, in violation of Article 134, Uniform Code of Military Justice, 50 USC § 728. He was sentenced to be discharged from the service with a bad-conduct discharge, to forfeit all pay allowances, to be confined at hard labor for two years, and to be reduced to the grade of private.
