The defendant was indicted under a bill of indictment charging him with murder in the first degree. "On the 31st day of August, in the year of our Lord one thousand nine hundred and thirty-eight, with force and arms, at and in the County aforesaid, unlawfully, willfully, feloniously, premeditatedly, deliberately and of his malice aforethought did kill and murder one W. H. Williamson, against the form of the statute in such case made and provided and against the peace and dignity of the State." N.C. Code, 1935 (Michie), secs. 4200 and 4614.
