The plaintiffs, who are the appellants, filed a taxpayers’ class bill against defendants, named as “Westmoreland County Institution District, a Municipal Corporation, George R. Sweeney, J. Calvin Turner and Prank K. Cochran,” and averred that Turner and Cochran were two of the county commissioners and, as such, were “the duly elected, qualified and acting majority of the Board of Commissioners of Westmoreland County, and by virtue of that office were a majority of the executive and administrative officers of the defendant, Westmoreland County Institution District.”…
