OPINION
HORN, Judge.
The case comes before the court following a contracting officer’s final decision, denying plaintiffs claim for an equitable adjustment under a contract for the production of floodlight sets for the United States Department of the Air Force. The plaintiff also asserted an adversary claim against the United States *778in the United States Bankruptcy Court for the District of Connecticut. The Bankruptcy Court dismissed the adversary proceeding without prejudice and ordered the plaintiff and the United States to refile their pleadings in the United States Court of Federal Claims.
