Plaintiff brought this action to recover damages for personal injuries sustained by him as the result of a collision between an automobile in which he was riding and a truck owned by defendant and operated by one of its employees. Upon the issues presented, the case was tried to a jury, which returned a verdict for plaintiff. Motion for new trial and motion for judgment notwithstanding the verdict were interposed by defendant. The court denied the motion for new trial, but granted the motion for judgment notwithstanding the verdict and, thereafter, entered judgment dismissing the action with…
