Appeal from a judgment of the superior court for King county, Griffin, J., entered July 26, 1907, upon the verdict of a jury rendered in favor of the plaintiff for personal injuries sustained by a section man thrown from a hand car.

This action was commenced by Albert E. Tills against the defendant, Great Northern Railway Company, to recover damages for personal injuries. From a judgment in his favor, the defendant has appealed.

*537The cause was submitted upon evidence offered by the respondent, the arguments of his counsel, and the instructions of the court.
