The complaint, so1 far as here material, may be summarized as follows :

On June 12, 1926, the plaintiff and the defendant Furniture Company, hereafter called the defendant, entered into a written contract covering a three-year period from January 1, 1926, to December 31, 1928, a copy of which contract is annexed to the complaint and made a part thereof; that on June 12, 1926, the defendants made, executed, and delivered to the plaintiff a bond in the penal sum of $50,000, and conditioned that the defendant would faithfully perform its contract, a copy of which bond is annexed to the complaint…
