The defendant’s motion to vacate an ex parte order authorizing resubmission of murder charges against the defendant to a Grand Jury raises two issues. The first is whether the procedure used by the Assistant District Attorney to obtain the order was constitutionally defective, since neither the defendant nor his attorney was given notice of the order nor the opportunity to oppose it.
