HODGES, Associate Justice.
In June, 1905, the appellant was erecting what is termed a “rock-crusher plant” at its quarry in Bell County, in and about which the appellee was at the time employed as a laborer. During the progress of the work a heavy piece of timber which had been placed in an upright position was pulled over, fell upon the appellee’s leg, and caused the injuries for which he instituted this suit and recovered a judgment.
