TALBOT, Associate Justice.

This is a personal injury suit. There is no controversy over the pleadings, and the evidence justifies the following conclusions of fact:

The defendant, at the time the plaintiff received the injuries complained of by him, was a private corporation engaged, among other things, in the business of manufacturing and repairing machinery, staircases, fire-escapes, and in doing structural work.
