Findings of Fact and Conclusions of Law

Plaintiff Perfect Fit Industries, Inc. (Perfect Fit), a Delaware corporation, has brought this suit against defendant Acme Quilting Co. (Acme), a New York Corporation, for false designation under the Lanham Act, 15 U.S.C. § 1125(a), and for unfair competition under New York law. A trial was held by the court. The court finds that Perfect Fit has failed to prove its two causes of action by a clear preponderance of the evidence.
