Plaintiff-appellant Robert Richards, a prisoner in the custody of the Oklahoma Department of Corrections, appeals the dismissal of his civil rights action under 42 U.S.C. § 1983. He seeks declaratory and injunctive relief, claiming that the failure of the Oklahoma Legislature to provide sufficient funds for the Oklahoma Appellate Public Defender System deprives him, and others who must rely on the services of the appellate public defender, of due process of law and equal protection.
