ORDER AND JUDGMENT *

SEYMOUR, Circuit Judge.

Plaintiffs, state prisoners appearing pro se, seek a certificate of appealability in order to challenge the district court’s dismissal of their petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254.1 The district court dismissed'the petition without prejudice on grounds that challenges to conditions of confinement may only be brought as a civil rights action pursuant to 42 U.S.C. § 1983. For the reasons stated below, we deny the request *245for a certificate of appealability and dismiss the appeal.
