The plaintiff brought this action to enforce an option to purchase real estate. The facts are not in dispute and are, briefly stated, as follows:

Imanuel Schulz died testate on March 20, 1956. At the time of his death, he was the owner of certain real property, including the Southwest Quarter (SW54) of Section 19; the South Half of the Southwest Quarter (S1/2SW14), the Northwest Quarter of the Southwest Quarter (NWi4SW]4)> and the Southwest Quarter of the Northwest Quarter (SWJ4NWJ4) of Section 32; all in Township 146, Range 89, Mercer County, North Dakota.
