ERICKSTAD, Chief Justice.

Mary Ann Parkhouse appeals from a district court judgment ordering her to convey to Leslie H. Loberg all her right, title and interest to certain real property she was given by the last will and testament of Alvhilda Loberg. Leslie cross-appeals from the judgment for purposes of preserving his right to recover damages against Shelley J. Lashkowitz should this Court reverse the judgment. Lashkowitz has filed a motion to dismiss the cross-appeal on grounds Leslie has accepted substantial benefits under the court’s judgment. We affirm the judgment and, accordingly, need…
