{¶ 1} This timely appeal comes for consideration upon the record in the trial court, the parties' briefs, and their oral arguments before this court. Defendant-Appellant, Mark Pietrzak, appeals the decision of the Columbiana County Court of Common Pleas that granted judgment to Plaintiff-Appellee, Henry Spack Service, Inc.
