Carter Leonard Davis, a minor twelve years and seven months of age, brought suit for damages on account of injuries received by him when he came in contact with an uninsulated high tension wire carrying 6900 volts of electricity while climbing a sycamore tree, after sycamore balls, located on the highway right-of-way in front of his home. The electric wires were owned and operated by the plaintiffs-in-error, Town of Clinton, Tennessee, and Clinton Power Commission, who were defendants below.
