On October 3, 1919, the plaintiff and the individual defendants entered into a written contract (subsequently taken over by the defendant P. K. Wilson & Son, Inc.) for the manufacture, purchase and sale of automobile tires. Under the terms of the contract the plaintiff agreed to manufacture, according to certain specifications to be furnished by defendants, sell and deliver to them in New York city, automobile tires for export to the value of $300,000, with an option to defendants to increase the number of tires specified to the value of $750,000.
