The Federal Maritime Commission (“FMC”) has filed an unprecedented motion for a preliminary injunction pursuant to the Shipping Act of 1984, as amended, 46 U.S.C. §§ 40101 et seq., to enjoin certain discrete portions of the Port of Los Angeles’s (“POLA”) and Port of Long Beach’s (“POLB”) (collectively, the “Ports”) respective Clean Truck Programs (“CTPs”).
