Michael Sundeen appeals the Pulaski County Circuit Court’s grant of summary judgment in favor of the Kroger and Jerry Hart, a Kroger employee (Kroger).1 Sundeen sued Kroger for malicious prosecution and abuse of process following the State’s nolle prosse of criminal charges alleging that Sundeen had obstructed governmental operations and attempted to influence a governmental official, arising from an incident at a Kroger Store.
