But little, if any conflict appears in the evidence material to a determination of the assignments of error. The facts in substance are: That on August 21, 1919, appellant and respondent entered into a contract by which appellant agreed to pay respondent $25,000 as purchase price for a half section of land described and respondent promised and agreed to convey by deed the land to appellant; the first payment of $1,000 to be made in cash at execution of contract.
