OPINION AND ORDER
CRABB, District Judge.
This is a civil action for declaratory relief brought pursuant to the Telecommunications Act of 1996, Pub.L. No. 104-104, 110 Stat. 56 (to be codified at various sections of 47 U.S.C.). Plaintiff provides local telephone service in southeastern Wisconsin. To compete for customers in this market, plaintiff entered into negotiations with defendant Ameritech Wisconsin aimed at establishing an agreement to interconnect with Ameritech’s telephone network.
