MEMORANDUM OPINION
KEVIN J. CAREY, Bankruptcy Judge.
On November 1, 2000, the debtor filed a complaint against Allegiance Telecom, Inc. 1 asking the Court to order the defen dant to restore telephone service to the debtor and establish a reasonable adequate assurance payment pursuant to 11 U.S.C. § 866. The debtor also sought the award of actual and punitive damages, including costs and attorney fees, against the defendant pursuant to 11 U.S.C. § 362(h).
