MEMORANDUM OPINION AND ORDER OF COURT
GIBSON, District Judge.
I. SYNOPSIS
This matter comes before the Court on the Motion for Summary Judgment (Document No. 30) filed by the Defendants. For the reasons that follow, this motion will be granted in part and denied in part.
II. BACKGROUND
On September 25, 2003, Bruce Lester (“Lester”) was assaulted by a black male. Document Nos. 32 & 34-3, ¶ 1. The black male was brandishing a shotgun, which discharged during the altercation. Id.
