On February 21, 1977, the defendant, Alfred Gf. Owen, filed a demurrer in this action to the complaint of the plaintiff, Susan Beynolds. For the reasons set forth below, the defendant’s demurrer to the first two counts is overruled, but his demurrer to the third count is sustained.

The first count of the plaintiff’s complaint sets forth the factual circumstances, delineated below, on which she bases her legal claims. On demurrer well pleaded factual allegations, including facts necessarily implied by those allegations, are admitted by the party demurring. Wachtel v. Rosol, 159 Conn. 496, 500.…
