This action was instituted by the company to recover a judgment upon several promissory notes executed by Harn and wife and delivered to the company for money loaned by it to them and to foreclose a real estate mortgage executed to secure the payment of the same.

The fourth amended petition upon which this action was tried contained four counts, the first of which stated a cause of action upon a note of $5,500 and two coupon notes of $220 each; the second was based upon a note for $5,500, and three coupon notes for $220 each; the third was upon a note for $44,000, and…
