The appeal in the instant case is from the judgment rendered and entered on the 16th day of May, 1949, in department No. 1 of the Second judicial district court of .the State of Nevada, in and for the county of Washoe, by the Honorable William McKnight, district judge, and from the district court’s order denying defendant’s motion for a new trial.
