I. OVERVIEW

Defendant-appellant, Calvin Cox (hereinafter “Defendant”), appeals from the decision of the United States District Court affirming his conviction under 18 U.S.C. § 13 1 (hereinafter “Assimilative Crimes Act”) of lewd and lascivious behavior in violation under K.S.A. 21-3508(l)(b) (1988). Defendant was convicted in a bench trial to the United States Magistrate Court at Leavenworth, Kansas, received a suspended sentence, and was placed on unsupervised probation for two years.
