In September, 1908, the receivers of Westinghouse Electric & Manufacturing Company entered into a written contract with the Ardmore Traction Company for the purchase of certain material in connection with the street railway at Ardmore, Okla., and Jo.e F. Robison, now deceased, guaranteed in writing the faithful performance of all the terms of the contract. The Ardmore Traction Company defaulted in the sum of $728.09 under the contract, and in September, 1910, the plaintiff filed with Frank Robison, the administrator of the estate of Joe F.
