The complaint alleges, among other things, that the appellee is the owner of the tract of land described; that an assessment was levied upon it for the purpose of constructing the Bluffton and Salamonie Gravel Eoad; that, on the 9th day of September, 1882, the final order levying the assessment was made by the board of commissioners; that, .afterwards, on the 6th day of June, 1884, without notice to the plaintiff, and without any notice whatever, the board of •commissioners entered an order levying an additional assess ment.
