This suit was brought by appellee against appellant to recover dara-agesk for personal injuries received at a public road crossing at a place where it was crossed by appellant’s track at practically right angles. Appellee was driving four mules to a wagon loaded with seed cotton, and just as he was getting across appellant’s track, the rear end of the wagon was struck by a car of appellant, demolishing the wagon and injuring appellee.
