Appeal by the plaintiff, James McHugh, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Hew York on the 2d day of March, 1898, upon the dismissal of the complaint by direction of the court after a trial at the Hew York Trial Term.

McLaughlin, J. :
On the 9th of December, 1895, the plaintiff, while driving a horse which was attached to an ash cart of the street cleaning department of the city of Hew York, was kicked by the horse he was driving and sustained a serious injury, and he has instituted this action against the city to recover damages for the injury thus sustained.
