THIS CAUSE comes before the court upon defendant’s motion to dismiss [DE # 8]. For the reasons given below, the court will grant the motion and dismiss the complaint.

Background

Plaintiffs Brian and Valerie Ditthardt entered into purchase agreements to buy condominium units from defendant North Ocean Condos, L.P. on August 12, 2005 and August 27, 2005 respectively.
