This matter comes before the undersigned on defendant’s Motion for Summary Judgment (doc. 58) and plaintiffs’ Motion for Partial Summary Judgment (doc. 67). These cross-motions have been the subject of extensive briefing, and are now ripe for disposition. 1 Also pending is defendant’s Motion for Leave to Submit Supplemental Evidence (doc. 57).
