Appeal from an order of the district court discharging a writ of habeas corpus.

On January 28, 1963, petitioner, represented by counsel of his own selection, entered a plea of guilty to the crime of burglary in the third degree. He was sentenced according to law for an indeterminate term. Execution of the sentence was stayed, however, upon condition that petitioner spend 1 year in the Hennepin County workhouse.
