This was an ejectment brought by the defendants in error against the plaintiff, to which he pleaded the general issue, and under the act of the 18th of October 1813 c 22. gave notice that he meant to claim on the trial the value of improvements made on the land; and under the same act, the defendants gave notice that they meant, to claim for mesne profits.

The notice on the part of the plaintiff was general ; it contained no specification of the improvements, for which compensation would be asked.
