DOOLING, J. pro tem.

Plaintiff appeals from a judgment for defendant in an action based upon an alleged trust. Plaintiff is the daughter of Nellie Patton, deceased, and step-daughter of George E. Patton, deceased. Nellie Patton died on February 10, 1940, leaving a will by which she bequeathed to appellant the sum of $2500. She, however, died without estate other than a piece of real property which was specifically devised for life to a son and daughter-in-law with remainder to a grandson.
