This suit was filed on November 28, 1911, in the district court of Pawnee county by Smith and Hudson, doing business as copartners, against Commonwealth Cotton Oil Company, as defendant, to recover (damages in a large sum, alleged to have been caused by the breach by defendant of the terms of a contract between the parties relative to furnishing yardage and facilities for watering a herd of cattle to be put on feed for’ the market.
