On the 4th day of February, 1922, Melba Fiske, plaintiff, commenced this action in the district court of Tulsa county against J. AT. Fisher, Roy Fisher, and John R. Boling, and others not material in this appeal. The action Was to recover for damages alleged to have resulted from injuries received in an automobile accident on the night of June 29, 1921, on Federal Drive near the city o£ Tulsa |.
