Under the bill of exceptions in this case, the proper practice in some important particulars respecting notices, of. non-payment of promissory notes and bills of exchange' is involved. It appears that the defendant was indorser of such a note, and at the trial the court instructed the jury, that if they believed that the notary made the inquiries stated in his depositions, and sent notice to the-defendant as therein stated, he being ignorant of his true-residence, that the notice was sufficient to charge the defendant,, and that, under the circumstances of the case as proved, it was not…
