Plaintiff Kent Baker (“Baker”) brings this action against defendants Urban Outfitters, Inc. and Urban Outfitters Wholesale, Inc. (collectively, “defendants” or “Urban”) for copyright infringement arising out of Urban’s failure to seek permission to use a photograph taken by Baker as a disposable paper insert in one of its plastic picture frames.
