First Southern Insurance Company (“First Southern”) appeals from a final judgment entered in the United States District Court for the Eastern District of Missouri, granting partial summary judgment in favor of Jim Lynch Enterprises, Inc. (“Lynch Enterprises”), James R. Lynch, and Daniel Norath on the issue of the duty to defend. For reversal, First Southern argues that the district court erred in determining that the breach of contract claim of the underlying suit was arguably within the policy coverage.
